Abstract

Legal developments on the global stage are indicative of efforts to establish a more equitable, peaceful, and stable global society. Nations endeavor to ensure the protection of fundamental rights, including intellectual property rights (IPR), for their citizens. In this regard, Indonesia faces significant challenges in safeguarding IPR, as evidenced by its placement on the Priority Watch List by the United States Trade Representative (USTR). Since being placed on the Priority Watch List (PWL) by the United States Trade Representative (USTR), Indonesia has endeavored to extricate itself from this designation. However, the status quo remains unaltered in 2024.The objective of this research is to provide an in-depth analysis of the challenges faced by Indonesia, including the prevalence of piracy, counterfeiting, and various intellectual property rights violations within the nation.It also encompasses an examination of law enforcement efforts aimed at facilitating Indonesia's departure from the PWL. The research method employed is a normative juridical approach, examining existing law enforcement policies and practices, complemented by a review of recent USTR reports. The findings indicate that the impact of Indonesia's inclusion on the Priority Watch List (PWL) is the United States Trade Representative's (USTR) monitoring of the protection of intellectual property rights in more than 100 trading partners and the conducting of unscheduled reviews of selected trading partners under Special Report 301.The PWL list indicates countries that show progress or regression in the protection of intellectual property rights.Overall, Indonesia's inclusion on the PWL list has implications for international trade policy and the risk of USTR surveillance and trade sanctions. Despite numerous endeavors across diverse sectors, challenges persist, including limited public legal awareness and inadequate resources.Significant concerns regarding the protection and enforcement of intellectual property rights, such as the prevalence of piracy and counterfeiting, and the absence of coordination among relevant authorities, have led to Indonesia's ongoing inclusion on the PWL list.
